In a landmark case, Front Partner Jocelyn Santana, won punitive damages against a driver who admitted to texting and driving while on the highways of Dade County. Jocelyn conducted a Perry Mason type deposition when she got the witness to admit that the defendant was texting and driving, and was trying to take pictures and send them to a boyfriend overseas using the cell phone app “WhatsApp”, she failed to even look at the road that was in front of her. Jocelyn got the defendant to admit that she knew that texting and driving was extremely dangerous and tantamount to drinking and driving.
An extensive brief was filed with the Circuit Court who held a Special Set hearing before ruling that the Goldberg & Rosen client would be entitled to punitive damages at trial where justice would be sought for the wrongful and gross negligent act of texting while driving, as well as for the punitive spinal cord injuries that were sustained as a result of this incident.
